1. THE BENGOM MARKETPLACE MODEL
Bengom is an online platform that allows independent third-party sellers (“Sellers”) to list and sell goods to customers (“Buyers”).
Facilitation Only: Bengom provides the technology for transactions but is not a party to the contract of sale between a Buyer and a Seller. No Ownership of Goods: Bengom does not hold stock, fulfill orders, or guarantee the quality of items listed by independent stores.
2. STORE OWNERSHIP & SELLER OBLIGATIONS
By creating a store on Bengom, you agree to:
Identity Verification: Provide accurate business and contact information as required by law (e.g., Digital Services Act).
Accurate Listings: Ensure all products are described accurately and prices are transparent, including the lowest price from the last 30 days during sales.
Legal Compliance: Follow all local consumer protection laws, including the Buyer’s right to a 14-day return period where applicable.
3. BUYER PROTECTIONS & PAYMENTS
Payments: All transactions must be processed through Bengom’s approved payment gateways.
Returns & Refunds: Each store may have its own policy, but it must meet the minimum legal standards for consumer rights in the Buyer’s jurisdiction.
Dispute Resolution: In the event of a conflict, Buyers should first contact the Seller. If unresolved, Bengom provides a mediation process to assist.
4. LIMITATION OF LIABILITY
“As Is” Basis: The platform is provided “as is.” Bengom does not warrant that the service will be uninterrupted or error-free.
Liability Cap: To the maximum extent permitted by law, Bengom’s total liability for any claim shall not exceed the total fees paid by the user to Bengom in the 12 months preceding the claim.
Indirect Losses: Bengom is not liable for indirect losses, such as loss of profit, loss of data, or damage to reputation resulting from a transaction on the platform.
5. PROHIBITED CONDUCT
Users may not:
List illegal, counterfeit, or prohibited goods.
Use automated scripts to scrape data or interfere with platform security.
Engage in fraudulent “cheap” pricing schemes that mislead consumers.
6. TERMINATION
Bengom reserves the right to suspend or terminate any account or store that violates these Terms, harms the community, or poses a legal risk to the platform.
